ORDER

1. There is no serious objection for condoning the delay from the SEIAA – Tamil Nadu. Considering the averments made in the affidavit filed in support of the delay condonation application and having been satisfied with the same, the delay of 55 days in filing the appeal is condoned.

2. Accordingly, the delay condonation application [I.A.

No.110 of 2024(SZ)] is allowed.

3. However, considering the days of delay, it would be appropriate to impose a cost of Rs. 5,000/- (Rupees Five Thousand only) on the applicant payable to the National Green Tribunal (Southern Zone) Regular Practitioner’s Association within a period of 10 days. Upon such deposit, the Association is directed to utilize the said amount for the purchase of books on environmental laws useful to the practitioners and report the compliance before the Registrar.

4. As the State Expert Appraisal Committee (SEAC) /2nd Respondent and the Department of Geology and Mining/3rd Respondent are not necessary parties to this proceeding, the learned counsel appearing for the applicant has given up.

5. In Appeal, let notice be issued to the sole respondent viz., SEIAA – Tamil Nadu through the Tribunal as well as privately.

6. The learned counsel Mr. S. Sai Sathya Jith accepts notice on behalf of the sole respondent viz., SEIAA – Tamil Nadu.

7. Post the matter on 28.11.2024.
