Heard learned counsel for the Parties.

Petitioner claims even though uncle of the Petitioner was made

party but there is collusion between the Petitioner and Opp. Party in

the Revision case to defeat the claim of the Petitioner.

This Writ Petition involves a challenge to the impugned order

at Annexure-1 passed by the Commissioner of Consolidation, Odisha,

Bhubaneswar in Revision Case No. 195 of 2014. Petitioner has clear

pleading here that proceeding under Section 37(1) of O.C.H. & P.F.L

Act not only did not involve the Petitioner the recorded tenant in

terms of the subsequent R.O.R. prepared in the year 1988

appearing at Annexure-3 clearly disclosing Petitioner to be praja

against the property involved herein, but the proceeding again

involved on the basis of R.O.R prepared in 1927-28, which has no

existence after preparation
