This CMP has been filed assailing the order dated 24^th

July, 2014 (Annexure-7) passed by learned Civil Judge (Junior

Division), Jaleswar in C.S. Case No.305 of 1999-I, whereby an

application for amendment of the plaint, has been rejected.

Mr. Mohanty, learned counsel for the Petitioners submits

that C.S. No.305 of 1999 has been filed for declaration of right,

title and interest and for permanent injunction. It is submitted that

the Plaintiff No.1, who was looking after the suit, fell ill from 12^th

February, 2017 to 4^th April, 2012, for which the suit was
