This matter is taken up through hybrid mode.

Order dated 1^st October, 2019 (Annexure-5) passed by

learned Additional Senior Civil Judge, Puri in C.S. No.791 of

2014 is under challenge in this CMP, whereby an application

filed under Order XXVI Rule 1 read with Order XVIII Rule

4(2) and (8) of the C.P.C. for examination of the Plaintiff

through commission has been allowed.

More than three years have already elapsed in the

meantime from the date of passing of the impugned order, no

plausible explanation has been offered explaining such

inordinate delay in filing the CMP. Hence, I am not inclined to

entertain the CMP, which is accordingly dismissed.
