At the instance of the opposite party no.2, the F.I.R. in Gunupur P.S. Case No.23 of 2017 came to be registered against the opposite party no.3 for the offences under Sections- 376(2)(i)/506/34 IPC read with Section-6 of the POCSO Act.

2. The present petition is filed by the victim of the case. When the investigation was going on, the statement of the victim was recorded under Section-164 Cr.P.C. She, inter alia, stated that she had love affair with the opposite party no.3/accused. Therefore, she went with the opposite party no.3 and on the promise of marriage, the opposite party no.3 has contacted sexual intercourse with her. Thereafter, there was a settlement between the parties. They have entered into a written agreement with an understanding that the opposite party no.3 would marry to the petitioner.
