1. Heard learned counsel for the Petitioner.

2. By means of this application the Petitioner seeks indulgence of

this Court in setting aside the order dated 11.09.2023 passed in

Criminal Appeal No.51 of 2023 by the learned Sessions Judge,

Balasore.

3. It is submitted by the learned counsel for the Petitioner that one

Puspalata Das (Opp.Party No.1 herein) claiming herself to be the

wife of the present Petitioner moved an application, i.e. D.V. Misc.

Case No.44 of 2021 before the learned J.M.F.C., Soro under Section

12 of the Protection of Women from Domestic Violence Act, 2005

(“PWDV Act” in short) praying for relief under various provisions

of the said Act including Sections 20 and 22 of the Act. Learned

court issued notice to the present Petitioner. As the Petitioner despite

service of the notice did not appear was set ex parte and the learned

Court be
