1. This matter is taken up through hybrid mode.

2. Heard learned counsel for the petitioner and

learned counsel for the State.

3. The petitioner is in custody in connection with

Sadar P.S. Case No. 646 of 2021 corresponding to

G.R. Case No. 1487 of 2021 pending in the court of

learned ADJ-cum-Special Judge(Vig), Dhenkanal.

4. Having regard to the severity of the allegations

and the fact that the trial is in progress, I am not

inclined to entertain this application, which is

therefore, rejected.

5. It is open to the petitioner to renew his prayer

after examination of the material witness.
