ORISSA HIGH COURT
Ananda Chandra Behera, J
Basantimani Sahoo – Appellant
Versus
State Of Odisha – Respondent
CRLMC No.1898 of 2025
For the Appellants/Petitioners: Basanta Kumar Das
For the Respondents: S. Behera
A non-bailable warrant becomes unenforceable if the specified date for execution has elapsed.
Headnote:This CRLMC has been filed by the petitioners under Section 482 of the Cr.P.C. praying for quashing an NBW/A issued against them. The petitioners had regularly appeared before the trial court post-bail, but defaulted on one occasion. The court reasoned that, per the Supreme Court ruling in Raghuvansh Dewanchand Bhasin v. State of Maharashtra, such warrants become unenforceable after specified dates. The NBW/A was thus quashed, allowing the petitioners to retain their previous bail status.
