Headnote:This judgment relates to the petition for interim bail in BLAPL No.8054 of 2025 filed by the petitioner who is a student. The court detailed the need for interim bail for the petitioner to appear in an upcoming competitive examination. ORDER

05.08.2025 Order No. I.A. No.821 of 2025

01. This matter is taken up through hybrid mode.

2. Though the BLAPL No.8054 of 2025 was presented on 31st July, 2025 for regular bail, I.A. No.821 of 2025 has been filed to grant interim bail for a period of three weeks on the ground the Petitioner is a student and unless he is not released on interim bail, he would be unable to appear in the competitive exam scheduled to be held on 8th August,2025.

As it is revealed from the admit card issued by the Odisha Sub-Ordinate Staff Selection Commission, as at Annexure-3 to the bail application, pursuant to the advertisement No.IIE-60/2023/938(C)/OSSSC dated 29th December, 2023, the Provisional Admission Letter has been issued in favour of the Petitioner to appear in the Combined Recruitment Examination-2023(IV) for recruitment to the posts of RI, ICDS Supervisor, ARI, Amin & SFS and the date of examination is scheduled to be held on 08.08.2025 from 02.00 PM to 5.00 PM and the reporting time for such examination has been scheduled to be at

12.30 PM.

As it is further revealed from the record, vide orders as at Annexure-2 series, previously, the Petitioner was released on interim bail vide order dated 17.06.2025 passed in BA No.748 of 2025, followed by order dated 03.07.2025 passed in BA No.878 of 2025 by the learned Sessions Judge, Puri, in order to enable the Petitioner to appear in the main TGT Science Teachers Examination scheduled to be held on 22.06.2025 and in the preliminary examination for the post of Sevak/Sevika & Tribal Language Teacher (TLT), Trained Graduate Teacher (TGT), Arts and Science to be held on 21.07.2025 respectively putting certain conditions for releasing the Petitioner on interim bail. Admittedly, the Petitioner did not flout the said conditions imposed by the learned Sessions Judge, Puri.

In view of the above, this Court is inclined to allow the interim application for bail enabling the Petitioner to appear in the Combined Recruitment Examination-2023 (IV), scheduled to be held on 08.08.2025. The Petitioner be released on interim bail with effect from 6th August, 2025 till 10th August, 2025 subject to furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand only) with two solvent sureties each for the like amount to the satisfaction of the learned JMFC, Cog-II, Puri with the following the conditions:-

(i). He shall surrender before the learned JMFC, Cog.II, Puri on 11.08.2025 at 10.30 AM positively.

(ii). He shall not try to tamper with the prosecution witnesses during the course of interim bail.

Violation of any of the above conditions shall entail cancellation of the interim bail.

6. Urgent certified copy of this order be granted on proper application in course of the day.
