01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Kujang PS Case No.440 of 2023 corresponding to CT Case No.32 of 2024 pending in the file of learned Addl. District and Sessions Judge, Kujang for commission of offences punishable U/Ss.302 of IPC, on the main allegation of committing murder of the deceased Siba Charan Sahani by piercing through a pointed bamboo stick.

In the course of hearing Mr. Debasnan Das, learned counsel for the petitioner by taking this Court through the evidence of sole eye witness-cum-PW.3 submits that she has although stated in examination chief about the occurrence, but in her cross-examination, she has admitted to have not seen the occurrence and therefore, the sole testimony of the eye witnesses having been demolished by the defence and the petitioner having been detained in cus
