01. 1. Heard Mr. Mohanty, learned counsel for the petitioner.

2. Instant revision is filed by the petitioner challenging the impugned order dated 18th September, 2025 passed in Criminal Appeal No. 57 of 2025 by the learned ADJ-cum-Special Judge (CBI-II), Bhubaneswar on the grounds stated.

3. The interim maintenance has been allowed, however, reduced to Rs.10,000/- which is opposed by the petitioner on the ground that there has been no domestic violence caused to opposite party No.1 and therefore, she is not entitled for the same.

inclined to issue notice to opposite party No.1.

5. Hence, it is ordered.

6. Notice to opposite party No.1 by Speed Post with a short returnable date and for the said purpose, requisites shall be filed by Mr. Mohanty, learned counsel for the petitioner within seven days from today.

7. List on 8th January, 2026 for hearing and final orders upon appearance of opposite party No.1.

2. Instant petition is filed for interim orders.

3. By claiming that the wife, namely, opposite party No.1 is not entitled any maintenance in absence of a domestic violence proved against the petitioner, the proceeding in Criminal Execution No. 90 of 2025 pending before the court of learned JMFC, (Cog.Taking-II), Bhubaneswar should be stayed as an interim measure.

above, this Court directs the petitioner to pay an amount of Rs.7,000/- towards maintenance to opposite party No.1 for the present till the next date of hearing. It is further directed that in the event, the above order is complied with, there shall be stay of further proceeding in Criminal Execution No. 90 of 2025 till the next date of hearing.

5. List on the date fixed.

6. A certified copy of this order be issued as per rules.
