01. 1. This matter was not in today’s list. On being mentioned, in terms of the assignment, taking into account the urgency thereof, the matter is taken up today (22.12.2025) as per special notice.

2. Heard learned Senior Counsel for the Petitioner, Mr. Sharma and learned counsel for the State.

3. The writ petition under Article 226 of the Constitution of India has been filed seeking the following relief;

“Under the aforesaid circumstances, it is humbly prayed that this Hon’ble Court shall graciously be pleased to issue Rule NISI calling upon the Opp. Parties to show cause as to why the communication dtd.20.12.2025 containing a circular No.24923 dtd. 19.12.2025 issued by Registrar Cooperative Society under Annexure-1 shall not be quashed and set-aside;

And if the opposite parties fail to show cause or show insufficient cause made the said Rule NISI absolute;

And further be pleased to issue a writ of certiorari in line with aforesaid Rule NISI quashing the communication and the circular as contained under Annexure-I till the disposal of the writ petition;

And further be pleased to direct the Opp. Parties to hold the meeting of the Managing Committee at Indian Red Cross Society, Red Cross Bhawan, Bhubaneswar xx xx or at any other place specified by the President of the bank Petitioner No.3 who has issued notice on such notice;

And pass any other order/orders, writ/writs, direction/directions, as the Hon’ble Court deem, fit and proper;

4. The Petitioner Nos.1 and 2 are the Directors of Odisha State Cooperative Bank Ltd. and Petitioner No.3 is President of the Bank.

4-A. It is apt to note here that by notice at Annexure-6 the Odisha State Cooperative Bank Ltd. convened a meeting of the Managing Committee of the Odisha State Cooperative Bank Ltd. on 23.12.2025 (Tuesday) at 11.30 AM in the premises of INDIAN RED CROSS SOCIETY, Red Cross Bhawan Bhubaneswar.

4-B. The agenda of the said meeting is extracted hereunder for convenience of reference;

1. To consider the report of the Superintendent of Police, Vigilance, Cuttack in Cuttack Vigilance P.S. Case No. 41 dated 31.08.2015, relating to Sanction of Prosecution against Sri Babaji Jena, Ex-Branch Manager (Retd.), OSCB, Cuttack Branch, and Sri Pradipta Kumar Choudhury, Ex-Loan Officer (Retd.), OSCB, Cuttack Branch and Sri Bipin Bihari Hota, Ex-Secretary Retd.), Balangir District Central Cooperative. Bank Ltd., in Sambalpur Vigilance P.S. Case No.79, 80 and 82 of 2016.

2. To discuss on the day to day affairs of the Bank.

4. To discuss for fixation of date for Annual General Body meeting of the Bank.

5. To discuss on Application to NABARD for sanction of the credit limit.

6. To discuss for reappointment of Statutory Auditor for the Financial Year 2025-

7. To discuss on Equity contribution to Sahakar SarathiPvt. Ltd. amounting Rs.7.14 Crore.

8. To discuss for payment of pending silting fees of Board of Directors.
