This matter is taken up through hybrid arrangement.
2. The petitioners being in custody in connection with Binika P.S. Case No.219 of 2025, corresponding to G.R. Case No.210 of 2025 pending in the Court of learned JMFC, Binika, registered for the alleged commission of offence under Section 78/179/180/61(2)(a) of the BNS, 2023 have filed this petition for their release on bail.

The brief fact of the case is that on 25.10.2025 at 11.22 a.m. the IIC., Binika P.S. being the informant drew a plain paper FIR to the effect that he received confidential tips from sources regarding possession of Fake Indian Currency Notes and deal of the same. He entered the facts in G.D. No. 14 dated 25.10.2025 and he along with his other staff proceeded to the spot. On the outskirt of Village- Phulmathi they found two boys were present in an isolated place. When they reached at the spot, both the persons present there started moving from the spot and when the police team restrained them and asked about their presence in the isolated places, they could not account for the same properly. On being asked, they disclosed that they are in possession of Fake Currency Notes of 500 hundred denominations and they have to circulate the same for their wrongful gain. On counting of the fake notes in presence of the witnesses, they got 232 nos. of notes having sl. No, 6SR856701, 110 nos. of note having sl. Nos. 6SR856668, 228 nos. of notes having SI. Nos.6SR856661, 233 nos of notes having sl. Nos. 6SR856618 and in total 803 nos. of fake currency notes aggregating an amount of Rs.4,01,500/-. They seized the currency notes which were kept inside the envelopes mentioning the serial numbers on the seizure list as per the provisions of law. They also seized the mobile phones of the petitioners. On further interrogation, both the accused confessed that one Jayanarayan Bastia of village-Rengali, Khaliapali under Laclihipur P.S. gave them the said fake currency notes after procuring from someone of Bargarh for the purpose of circulation of the same in the market for their wrongful gain.
4. Learned counsel for the Petitioners submits that the Petitioners have been languishing in custody since 26.10.2025. He further submits that the allegation against the Petitioners are false and fabricated one. The petitioners have no antecedents to their credit and they have been falsely entangled in the present case. The relevant procedures have not been followed by the informant before proceeding to the spot and during seizure of the currency notes. Therefore, learned counsel for the petitioner prays that the bail application of the petitioners may be favorably considered and they may be allowed to go on bail in the interest of justice.
5. Learned counsel for the State vehemently opposes the bail prayer of the Petitioners on the ground that huge amount of fake currency was recovered in the present case and it is an economic offence.

Considering the submissions made and on going through the materials as placed, further keeping in view the role said to have been played by this Petitioners, this Court is not inclined to release the petitioners on bail. However, the Petitioners are granted liberty to renew their prayer after charge sheet is filed.
7. Accordingly, the BLAPL is dismissed.
8. Issue urgent certified copy of the order pas per Rules.
