08. 1. Both the cases are placed before the 4th National Lok Adalat.

2. In MACA No.412 of 2024, the Insurance Company approached this Court challenging the order dated 14.11.2023 passed by the First Motor Accident Claims Tribunal, Jajpur in M.A.C.C. No.136 of 2013.

3. In MACA No.561 of 2024, the claimant has approached this court for enhancement of the compensation amount awarded in the said M.A.C.C.

4. Representative of Insurance Company – United India Insurance Co. Ltd. has agreed to settle the dispute on payment of Rs.42,00,000/- consolidated to which learned counsel for claimant has agreed. In this regard, they have filed a joint compromise sheet, which be kept on record.

5. In view of such settlement having been arrived at in between the parties, both the cases are being finally disposed of with a direction to the Insurance Company to pay Rs.42,00,000/- (Rupees forty two lakhs) consolidated to the Claimant-Pravat Kumar Barik within a period of eight weeks from today, failing which, the Insurance Company will be liable to pay interest @ 9% per annum from the date of default till realization. The amount shall be disbursed to the Claimant on proper identification.

6. It is open for the Insurance Company to make proper application for refund of the statutory deposit made before the court.

7. If such application will be filed, the court will refund the amount on proper identification forthwith.

8. Both the appeals are disposed of accordingly.
