Order No. 30.12.2025

01. 1. This matter is taken up through hybrid mode.

2. This writ petition has been filed for a direction to the Opposite Party No.5 to act upon of the letter dated 30.09.2023

(Annexure-1)

3. It appears that vide the said letter, the Petitioner – Institution had been granted recognition for continuance of ANM/GNM/BSc.(N)/ B.B.Sc.(N) P.B. Diploma Nursing Couse for the academic Session 2023-24. The following stipulations had been indicated in the said letter:-

Application for renewal of NOC of the petitioner’s institutions and other institution have not been recommended by order dated 06.08.2025 (Annexure-9) by the Odisha Nurses and Midwives Registration Council. The name of the Petitioner – Institution appears at Sl. No. 10. The entry indicates Petitioner – Institution had applied for renewal in the M.Sc-N, ANM, PB Diploma GNM, PB BSc-N, Phd and B.Sc-N and reason for not recommending is “Valid fire safety certificate From-V from DFO as per building completion certificate not submitted”.

5. Mr. Rout, learned counsel submits that the defect has been removed in the meanwhile. Fire Safety Certificate in Form-V (Annexure-14) was granted on 18.11.2025 and the Petitioner – Institution has submitted the Fire Safety Certificate on 19.11.2025 along with an application (Annexure-6-Series). So the application for renewal of NOC may be considered as the last date for admission to the courses has been extended till

31.12.2025.

6. Mr. Rajani Chandra Mohanty, learned counsel appearing on behalf of Opposite Party Nos. 2 and 3 submits that as per letter No.516 dated 29.12.2025 of the DMET, regarding extension of date for uploading details of students admitted under Management quota: -

“…the Indian Nursing council (INC), New Delhi has extended that last date of admission for ANM, GNM, Basic B.Sc. Nursing, Post Basic B.Sc. Nursing and M.Sc. Nursing courses upto

31.12.2025.

Accordingly, the last date for uploading details of students admitted under the Management Quota, which was 30.11.2025 for post Basic B.Sc. and M.Sc. Nursing courses and 31.12.2025 for ANM, GNM and Basic B.Sc. Nursing Courses, is hereby extended up to 31.01.2026 in the admission portal.”

The letter is taken on record.

In view of the decision of the DMET as conveyed through Mr. Rajani Chandra Mohanty, learned counsel and the submission of the learned counsel for the Petitioner that the Petitioner – Institution has removed the defect indicated in order dated 06.08.2025 and the compliance submitted to DMET on 19.11.2025, without going into the merits of the case of the Petitioner - Institution for renewal of NOC, it is directed that if the application for renewal for NOC is covered by INC Notification dated 24.12.2025 and letter No. 516 dated 29.12.2025 of the DMET, it may be considered strictly in accordance with law before the last date fixed by the Indian Nursing Council i.e. (31.12.2025) provided there is no other legal impediment.

8. The writ petition stands disposed of accordingly.
