1. The grievance of the Petitioner is that although the learned Grama Nyayadhikari-cum-J.M.F.C., Kashinagar has issued process under Sections 82 and 83 of the Cr.P.C. but the provisions under Section 82 of

the Cr.P.C. has not been complied with.

2. Mr. Surendra Mohanty, learned counsel for the Petitioner submits that as required under Section 82 of the Cr.P.C. (i) proclamation has not been publicly read in some conspicuous place of the town or village in which the accused ordinarily resides; (ii) it has not been affixed in some conspicuous part of the house of the accused’ (iii) copy has not been

affixed in some conspicuous part of the Court-house.
