CORAM:
THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA
ORDER
19.02.2026 Order No.
02. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).
2. Heard learned counsel for the Petitioner as well as learned Additional Government Advocate appearing for the State-Opposite Parties. Perused the writ petition as well as the documents annexed thereto.
3. The present writ petition has been filed by the Petitioner with the following prayers:-
“The petitioner, therefore, most humbly prays that this Hon’ble Court may graciously be pleased to admit the writ petition, issue rule Nisi calling upon the Opposite Parties to show cause as to why:-
(i) the direction shall not be issue to the Opposite Parties to comply the order dated 29.03.2019 passed in O.A.No.1179 of 2019 by the Odisha State Administrative Tribunal, Principal Bench, Bhubaneswar as well as order dated. 27.04.2023 passed by this Hon’ble Court in W.P.(C)
No.7324 of 2020 with later and spirit.
(ii) a specific direction shall not be issued to the Opposite Parties to release payment of salary of the petitioner from December, 2007, March-April, 2008 and 24 days in the month of May, 2008 along with 41% and 47% D.A. arrears and annual periodical increment since 2008 in favour of the petitioner within a stipulated period.
And if the Opposite Parties fail to show cause or show insufficient cause to make the said rule absolute by issuance of an appropriate writ(s), order(s), direction(s) as this Hon’ble Court may deem fit and proper under the facts and circumstances of the present case.”
4. Learned counsel for the Petitioner at the outset contended that initially the Petitioner approached the learned Odisha Administrative Tribunal by filing O.A No.179 of 2019 which was disposed of vide order dated 28.03.2019. He further contended that order dated 28.03.2019 having not been challenged by the State- Opposite Parties has attained finality in the meantime. He further submitted that the grievance of the Petitioner in the present writ application is that despite order dated 28.03.2019 having attained finality, the same is not being implemented by the Opposite Parties. 5. Learned counsel for the Petitioner further contended that earlier the petitioner approached this Court by filing W.P.(C) No.7324 of 2020 for a direction to the Opposite Parties to implement the order passed by the Tribunal. A Coordinate Bench of this Court vide order dated 27.04.2023 disposed of the writ petition by granting two months’ time to implement the order of the Tribunal. Despite such clear direction by the Coordinate Bench in the earlier writ application, the order has not been implemented as of now. He further submitted that the conduct of the Opposite Parties clearly construed an act of Contempt of this Court. However, since the filing of the contempt application was barred by limitation, the Petitioner could not approach this Court by filing the contempt application. In such view of the matter, learned counsel for the Petitioner further contended that the Petitioner has once again approached this Court by filing the present writ application for a direction to the Opposite Parties to implement the order passed by the learned O.A.T.
6. Taking into consideration the aforesaid facts, this Court deems it proper to dispose of the present writ application at the stage of admission by directing the Opposite Parties to implement the order dated 28.03.2019 passed in O.A No.179 of 2019, if the same has attained finality in the meantime, within a period of six weeks. The Petitioner is directed to approach the Opposite Party No.1 along with a copy of today’s order and a copy of order dated 28.03.2019 passed in O.A. No.179 of 2019 within a week from today.
