03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with CID CB PS Case No. 26 of 2024 corresponding to GR Case No. 447 of 2024 pending in the Court of learned JMFC- III(Cognizance Taking), Cuttack for commission of offences punishable U/Ss.419/ 420/ 465/ 467/ 468/ 471/ 120(B)/34 of IPC r/w Sections 66(C)/66(D) of the IT Act, on the main allegation of alluring the informant to invest the money on the assurance of high returns and in the process, cheating him for a sum of Rs.

47,20,000/- by way of cyber fraud and forgery.

In the course of hearing, Mr. Rajendra Narayan Rout, learned counsel for the Petitioner submits that the Petitioner in fact does not know the informant and the amount that has been credited to his account is not opened by him and thereby, he has no role in committing any crime and, therefore, the Petitioner having detained in custody since 07.05.2025 may kindly be granted bail.

3.1. On the other hand, Mr. S.C. Pradhan, learned Addl. PP by producing the written instruction received from DSP, CID, CB, Odisha, Cuttack-cum-IO submits that not only the Petitioner has duped the informant, but also around 201 complaints have been registered against the account number of the Petitioner as per JMIS Portal of Home Department.

After having considered the rival submissions upon perusal of record, there appears allegation against the Petitioner for duping the informant by receiving a sum of Rs. 11,50,000/- in the account of CCEHD HYUNDAI TECH CO belonging to him and transferring the said amount to different other accounts through UPI transaction. From the rival submission and written instruction received from the IO reveals that not only the Petitioner has allegedly duped the present Petitioner, but also 201 numbers of complaints have been registered against the account number- 42846652453 standing in the name of CCEHD HYUNDAI TECH CO belonging to the Petitioner.

In the aforesaid facts and circumstance and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-a-vis the allegation sought to be brought against him and regard being had to the materials placed on record and there being not only the solitary allegation, but also for other allegation raised against the account number of the Petitioner, this Court is not inclined to grant bail to the Petitioner at this stage.

Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately transmitted to the learned trial Court.
