13.01.2026 Order No.

01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State-Opposite Party. Perused the writ application as well as the documents annexed thereto.

3. The Petitioner has filed the present writ petition with the following prayer:

“Under the circumstances, it is humbly therefore prayed that this Hon'ble Court may graciously be pleased to issue a writ in the nature of mandamus or any other appropriate writ/writs by directing the opposite party No.l to release the arrear salary of the petitioner for the period w.e.f. 01.04.2001 till 04.08.2003 keeping in view the submission of actual financial benefits statement made by the opp. party No.

3 under Annexure- 14 series and extend the benefit of arrear salary as has been given to Kamal Lochan Dora as per letter of Director dated 01.02.2022 and Mihir Ranjan Naik & Abhisikta Sahoo;

And further be pleased to direct the opp.party No.l to consider the representation of the petitioner dated 04.12.2022 under Annexure-18. Keeping in view the order of Hon'ble Court dated 31.01.2023 passed in W.P.C (OAC) No. /2018 under Annexure -19;

Or pass any other order/orders as this Hon'ble Court may think deem fit and proper;

And allow this writ application. ”

In course of hearing of the writ application, learned counsel for the Petitioner submits that the Petitioner ventilating his grievance has submitted representation dated 04.12.2024 before the Opposite Party No.1 under Annexure-18. It is also submitted by the learned counsel for the Petitioner that the said representation is pending as of now. It is also submitted by the learned counsel for the Petitioner that a direction be issued to the Opposite Party No.1 to consider the representation of the Petitioner under Annexure-18 within a stipulated period of time.

5. Learned Additional Standing Counsel submits that he has no objection if the representation of the Petitioner is considered by the Opposite Party No.1, which is stated to be pending, in accordance with law within a stipulated period of time.

6. Considering the limited nature of grievance of the Petitioner, the writ application is disposed of at the stage of admission with a direction to the Opposite Party No.1 to consider the representation of the Petitioner under Annexure-18 by taking into consideration order dated 30.01.2023 at Annexure-19, within a period of eight weeks from the date of production of certified copy of this order. The Opposite Party No.1 shall do well to dispose of the representation of the Petitioner under Annexure-18 by passing a speaking and reasoned order. The decision so taken by the Opposite Party No.1 on such representation be communicated to the Petitioner within ten days thereafter.

7. With the aforesaid observation/ direction, the writ application stands disposed of.

Issue urgent certified copy of this order as per Rules.
