1. In the present case, the petitioner is seeking quashing of the F.I.R. in connection with Nayapalli P.S. Case No.657 of 2022 corresponding to T.R. Case No.439 of 2022 for the alleged commission of the offence punishable under Section 67/67(A) of the I.T. Act, 2000 read with Section 12 of the POCSO Act, 2012, pending in the Court of the learned Additional Sessions Judge, Bhubaneswar, wherein he has been implicated as co-accused on the sole ground that the F.I.R. was registered way back on 09.10.2022. However, the charge sheet has not yet been filed by the investigating officer.

2. This Court directed the learned State counsel to obtain instruction regarding the status of investigation vide order dated 12.11.2025 and 10.12.2025. However, no instruction has yet been obtained. Therefore, vide order dated 12.01.2026, this Court directed the IIC, Nayapalli Police Station, Bhubaneswar to appear before this Court through virtual mode to ascertain as to whether the charge sheet has been filed in this matter or not.

Today, Mr. Manas Kumar Sahoo, IIC of Nayapalli Police Station, Bhubaneswar has appeared in person before this Court and submits that the charge sheet is ready and he would be filing the same before the learned trial Court during the course of the day. He has also undertaken to give photocopy of the entire charge sheet to the petitioner after filing of the same before the learned trial Court.

4. This Court records dissatisfaction on the delayed investigation and filing of charge sheet after about 3 years from the registration of F.I.R.. Be that as it may, since the charge sheet is going to be filed today before the learned trial Court and the allegations are made against the petitioner in the charge sheet, hence, I am not inclined to entertain the present petition at this stage. However, liberty is granted to the petitioner to renew the prayer, if so advised, after he receives the copy of the charge sheet.

5. With the aforementioned observation, the CRLMC is disposed of.
