1. This CRLMP has been filed with the prayer to conduct an immediate, effective, time-bound investigation and trace, rescue and produce the kidnapped minor daughter of the petitioner and to direct constitution of a Special Investigation Team (SIT) for urgent search operations and to direct disciplinary action against erring police officials for their gross inaction and directions to monitor the investigation including period status reports.

On 12.01.2026, the learned State counsel had been directed to obtain instruction as it was stated in the instruction dated 20.12.2025 of the SI, Tirtol Police Station that the victim girl had herself appeared before the Police Station on 01.12.2025 and stating that on 08.11.2025 she had left her house and gone in a bus to Bhubaneswar, where was staying with her friend in a hostel in Bhubaneswar and that she had left her house being annoyed with her parents and nobody had kidnapped her. When she was produced

183 of the BNSS, the learned JMFC rejected the same and directed the victim girl to be present on 27.12.2025 for recording of her statement.

3. Instruction dated 15.01.2026 of Mr. B. K. Biswal, SI Tirtol Police Station is produced, where it is stated that Tirtol P.S. Case No.581 of 2025 had been registered on 09.01.2025 under Sections- 137(2) of the BNS against one Rahul Gantayat on the complaint of wife of the Petitioner who reported that their minor daughter had been kidnapped by the accused. Her statement was recorded by a lady police officer in presence of her mother at Mahila sisu desk of the Tirtol Police Station. She was produced before the learned JMFC, Tirtol, for recording her statement under Section 183 of the BNSS, who rejected the prayer and directed her to appear on 27.12.2025. He had instructed the parents of the victim girl to reach the Tirtol Police Station on 27.12.2025 for further investigation in the case and recording of her statement, but the petitioner- Pranasindhu Rout appeared on that date and gave written instructions that the health of his daughter was not good, for which he could not produce her at the Police Station for further investigation. The copy of his written intimation is attached with the instruction. On 29.12.2025, the Petitioner again appeared at Tirtol Police Station and gave a report regarding kidnapping of his minor daughter. Basing upon which Tirtol PS Case No. 659 of 2025 had been registered. But the statement of minor victim girl could not be recorded under Section 183 of the BNSS in the above circumstance. The said instructions are taken on record. The same shall be scanned and incorporated in the digital record.

4. In view of the above developments and the non-cooperation of 183 of BNSS in Tirtol P.S. Case No.581 of 2025, I do not think there is any necessity to proceed further in this CRLMP.

5. The CRLMP is disposed of.
