15. 1. Heard Mr. Hrudananda Mohapatra, learned counsel learned counsel appearing for the Respondent-husband through virtual mode.

2. The Respondent-husband as petitioner earlier filed Civil Proceeding No.232 of 2017 under Section-13(1)(i-a) of the Hindu Marriage Act, 1955 before the Court of learned Judge, Family Court, Puri to dissolve his marriage with the Appellant-

wife that was solemnized on 30.11.2000.

3. After hearing the learned counsel for the petitioner (respondent herein), the learned Judge, Family Court, Puri by the impugned ex parte judgment dated 05.09.2019 allowed the said Civil Proceeding No.232 of 2017 preferred by the Respondent-husband.

4. Aggrieved by the said ex parte judgment dated 05.09.2019, the Appellant-wife preferred this appeal under Section 19 of the Family Court’s Act.

5. Mr. Trilochan Panigrahi, learned counsel appearing for the Respondent-husband on the other hand submitted that the Appellant-wife has also filed an application under Order- IX, Rule 13 of the Code of Civil Procedure, 1908 before the Court of learned Judge, Family Court, Puri, pertaining to said ex parte Judgment dated 05.09.2019, which is presently pending for adjudication.

6. At this stage, Mr. Hrudananda Mohapatra, learned prays for withdrawal of this appeal submitting that the appellant shall pursue the application under Order IX, Rule 13, of CPC, pending before the Court of learned Judge, Family Court, Puri.

7. Accordingly, the appeal stands disposed of.

8. Communicate this order to the learned Judge, Family Court, Puri.
