02. 1. Heard Mr. S. Bahadur, learned counsel appearing for the appellant-husband, and Mr. A.K. Nath, learned counsel appearing for the respondent-wife.

2. The appellant-husband is before this Court challenging the judgment and decree dated 13.03.2025 passed by learned Judge, Family Court, Angul in Civil Proceeding No.02/2022, by which the application under Section 13(1)(i-a) of the Hindu Marriage Act, 1955 filed by him against the respondent-wife for dissolution of their marriage solemnized on 11.07.2018, was rejected.

3. The appellant-husband filed the appeal, MATA No.235 of

2025, with a reported delay of 17 days.

4. Mr. A.K. Nath, learned counsel appearing for the respondent, submits that the respondent-wife has no objection if the said delay of 17 days is condoned subject to payment of fine by the appellant.

5. Heard learned counsels for the parties. We have also gone through the delay condonation petition of the applicant-appellant. We direct that, subject to the payment of Rs.5,000/- to the respondent-wife within a period of four weeks from today, the delay of 17 days in filing the appeal shall be condoned.

6. The I.A. stands disposed of.

7. Heard Mr. S. Bahadur, learned counsel appearing for the appellant-husband, and Mr. A.K. Nath, learned counsel appearing for the respondent-wife.

8. Subject to the payment of Rs.5,000/- (Rupees Five Thousand) to the respondent-wife, as directed above, the appeal shall be admitted.

9. On the next date of hearing of the matter, the appellant shall place the proof of payment of the said amount.

10. As Mr. A.K. Nath, learned counsel has entered appearance on behalf of the respondent-wife, no formal notice need be issued to the said respondent. Appellant shall serve a Memo of this Appeal along with the Annexures to Mr. Nath within the next four working days.

11. Call for the scanned copies of Civil Proceeding No.02 of 2022 from the Court of learned Judge, Family Court, Angul, which was disposed of on 13.03.2025.

12. List the matter after receipt of Trial Court Records along
