01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

2. Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State-Opposite Parties.

Perused the writ application as well as the prayer made therein.

3. The Petitioner has filed the present writ application with the following prayer:

“In the facts and circumstances of the case the humble petitioner fervently prays this Hon'ble Court to be graciously pleased to issue notice to the 0pp.parties, call for relevant records and after hearing the Counsel of parties, issue a writ in the nature of Mandamus or any appropriate writ commanding Opp.parties particularly to the Opp.party No.l, the Commissioner- cum-Secretary, School and Mass Education Department, Odisha to sanction and disburse arrear salary to the petitioner from 01.06.1994 to February

1998, February 1999, May 1999 to December 1999. January 2000 to February 2001 and for the period from March 2001 to February 2010 treating the same as duty period with continuity of service and consequential benefits in terms of the decision rendered by the Hon'ble Apex Court in the case of State of Odisha and others Vrs. Bhakta Ranjan Dixit and another) (SLP No. 7197 of 2019 and batch of cases), within a stipulated period. And/or pass such other order or direction as deems fit and proper in the interest of justice.”

In course of hearing of the writ application, learned counsel for the Petitioner submits that the Petitioner ventilating his grievance has submitted representation before the State of Odisha represented by the Commissioner-cum-Secretary, School & Mass Education Department, Bhubaneswar, Opposite Party No.1 under Annexure-1. It is also submitted by the learned counsel for the Petitioner that the said representation is pending as of now. It is also submitted by the learned counsel for the Petitioner that a direction be issued to the Opposite Party No.1 to consider the representation of the Petitioner under Annexure-1 within a stipulated period of time.

5. Learned Additional Standing Counsel submits that he has no objection if the representation of the Petitioner is considered by the Opposite Party No.1, which is stated to be pending, in accordance with law within a stipulated period of time.

6. Considering the limited nature of grievance of the Petitioner, the writ application is disposed of at the stage of admission with a direction to the Opposite Party No.1 to consider the representation dated 20.08.2024 of the Petitioner under Annexure-1 keeping in view under Annexure-9 within a period of eight weeks from the date of production of certified copy of this order. The Opposite Party No.1 shall do well to dispose of the representation of the Petitioner under Annexure-1 by passing a speaking and reasoned order. The decision so taken by the Opposite Party No.1 be also communicated to the Petitioner within ten days thereafter.

7. With the aforesaid observation, the writ application stands disposed of.

8. Issue urgent certified copy of this order as per Rules.
