ORISSA HIGH COURT
MADANCHAN SATNAMI – Appellant
Versus
HEERAMAN SATNAMI – Respondent
WP(C) 2392 / 2026

IN THE HIGH COURT OF ORISSA AT CUTTACK WP(C) No.2392 of 2026 Madanchan Satnami ..... Petitioner Represented by Adv. - Sushanta Kumar Joshi -versus-

Heeraman Satnami and others ..... Opposite Parties Represented by Adv. -

CORAM:

THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA

ORDER

28.01.2026 Order No.

01. 1. This matter is taken up through Hybrid mode.

2. Heard learned counsel for the Petitioner as well as learned counsel for the State-Opposite Parties. Perused the writ application as well as the documents annexed thereto.

3. The Petitioner has filed the present writ application with the following prayer:

“It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to admit the writ petition call for records, issue notice to the other sides and after hearing both the parties the writ petition be allowed and the order dated 05/07/2024 passed by the Sub Judge, Nuapada in the Lok Adalat be set aside and as per the compromise petition the respective share be given to each of the parties failing which the petitioner will seriously prejudice.

And pass any other order/orders as deemed fit and proper in the interest of justice.”

4. Learned counsel for the Petitioner at the outset contended that the Petitioner has approached this Court being aggrieved by the inaction of the plaintiff to abide by the decree at Annexure-1, which was drawn up on a compromise arrived between the parties in a Lok Adalat. He further submitted that Civil Suit No.194 of 2023, which was pending in the Court of learned Civil Judge (Sr. Division), Nuapada, was settled in a Lok Adalat. Accordingly, a decree was drawn up on 11.07.2024. The sole grievance of the Petitioner before this Court is that although a compromise decree has already been drawn, however, the parties to the suit are not abiding by such decree.

5. Taking into consideration the grievance of the Petitioner in the present writ petition, this Court is of the view that a decree has already been drawn up at Annexure-1 which is manifest on record. Since such decree is an executable decree like any other decree drawn up by the civil court, it is open to the civil court to proceed with the execution of such decree. In view of the aforesaid settled legal position the present writ petition is being disposed of by granting liberty to the Petitioner to file an execution case for execution of the decree which has been drawn up on the basis of the settlement arrived in the Lok Adalat.

6. With the aforesaid observations/directions, the writ application stands disposed of.

Issue urgent certified copy of this order as per Rules.
