03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. This is the bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Dharamgarh P.S. Case No.33 of 2025 corresponding to C.T. Case No.35 of 2025(Sessions) pending in the Court of learned Additional Sessions Judge, Dharamgarh, for offence punishable U/Ss.310(2)/331(6) of BNS r/w Sec. 25 & 27 of Arms Act on the main allegation of committing dacoity by entering into the distillery and taking away cash of Rs.3/- crores approximately.

3. Heard Mr. Suryakanta Dwibedi, learned counsel for the petitioner and Mr.C.Mohanty, learned Addl. Public Prosecutor in the matter and perused the record. On being queried about the criminal antecedent of the petitioner, Mr. Mohapatra volunteers to withhold bail to the petitioner, if he is found to have been identified in TI parade and if he is having any criminal antecedent relating to property offence.
