HIGH COURT OF ORISSA
K. S. JHAVERI, CJ, K.R.MOHAPATRA, J
STATE OF ORISSA – Appellant
Versus
AHOK KUMAR DUTTA – Respondent
WP(C)/4485/2018

02. 03.1.2019

Heard

learned

counsel

for

the

petitioners-

Department.

By way of this writ petition, the petitioners have

prayed for the following relief:

“xxx Hon’ble Court may hold that the contempt

proceeding being C.P.No.171(C) of 2017 filed by

the opp. Party/applicant which is subjudice

before the learned Tribunal is baseless and not

maintenable in the eye of law and accordingly

the same may be dropped in the interest of

justice. xxx .”

Considering the submissions made, we see no

reason to interfere with the order of the learned Tribunal as

maintainability of the contempt proceeding can be well

looked into by learned Tribunal itself before whom the

proceeding is pending.

However, it is open for the original applicant to

challenge the rejection of the representation before the

learned Tribunal by filing appropriate petition.

The writ petition is accordingly disposed of.

All

connected

Misc.Cases/I.As.,

if

any

are

accordingly disposed of.
