ORAL JUDGMENT

Date : 02-05-2023 Heard learned counsels for the parties.

2. In the instant petition, petitioner has prayed for following reliefs:-

"i) For issuance of a writ/ order/

direction in the nature of certiorari for quashing the order dated 12.12.2015 of the State Government issued by the respondent Executive Engineer, Bihar State Tourism Development Corporation Ltd. Patna on behalf of the State Government by which the agreement bearing no. 02/SBD/2013 dated 18.2.2013 entered with the petitioner in relation to development of tourism infrastructure at Baba Mahendranath Temple, Siwan, Phase-II has been cancelled, the security deposit seized and the petitioner blacklisted (Annexure-21)

ii) For issuance of a writ/ order/

direction in the nature of Mandamus directing the respondent authorities to refund the security deposit of the petitioner which has been illegally forfeited wholly without jurisdiction.

iii) For issuance of such other writ(s), order(s), direction(s) as your Lordships may deem fit and proper."

3. In not executing certain works assigned to petitioner within the time limit stipulated, he has been blacklisted on 12.12.2015. Communication dated 12.12.2015 (Annexure-21)

4. Perusal of the same it is evident that petitioner has not been heard before blacklisting. The other side have not disputed the factual aspects of the matter. Accordingly, the petitioner has made out a case. Hence, Annexure-21 dated 12.12.2015, blacklisting order, stands set aside reserving liberty to the petitioner insofar as withholding of security deposit is concerned he is at liberty to invoke remedy under Clause 25 of the SBD. With the above observations the present petition stands disposed of. Any other dues are required to be settled by the respondent. In this regard, petitioner is hereby directed to furnish a detailed representation before the concerned authority. If such representation is submitted, the concerned authority shall examine and resolve the issue.
