ORAL JUDGMENT

Date : 16-01-2024 Heard Mr. Shiv Kumar, learned counsel appearing on behalf of the petitioner, Mr. Randhir Kumar, learned counsel for the State and Mr. Arun Kumar Arun, learned counsel for the Accountant General.

2. The petitioner, who happens to be husband of the erstwhile employee (late Kanti Sinha), filed the present writ petition seeking a direction upon the respondent authorities to ensure fixation and payment of the family pension, gratuity, leave encashment, dues salary payable to the petitioner on account of death of his wife.

3. It is submitted on behalf of the petitioner that admittedly, due to intervention of the Hon’ble Court, certain substantive amounts have been paid to the petitioner, however, till date, the claim of the petitioner for family pension has not been considered, despite the fact the petitioner made proper representation before the Civil Surgeon-cum-Chief Medical Officer, Darbhanga way back on 27.11.2017, itself. He further submits that the claim of the petitioner is entirely based upon a judgment rendered by a co-ordinate Bench of this Court in the case of Raghunandan Mishra Vs. The State of Bihar and Ors. reported in [1985 PLJR 446], where,
