Heard learned counsel for the petitioner and learned

APP for the State.

The petitioner is in custody in a case registered for the

offence punishable under Sections 20(b)(ii)(c), 23(c), 25, 27A

and 29 of the NDPS Act.

Allegedly, it is a case of recovery 1306 Kg. of ganja

from a truck.

Learned counsel for the petitioner submits that

petitioner has falsely been implicated in this case. He further

submits that similarly situated co-accused persons have been

granted regular bail by a Co-ordinate Bench of this Court passed

in Cr. Misc. No. 16485 of 2020 and Cr. Misc. No. 35679 of

Patna High Court CR. MISC. No.43865 of 2022(4) dt.09-01-2023

2020. Petitioner is in judicial custody since 16.06.2017.

Learned APP appearing for the State has opposed the

prayer for regular bail.

Having heard learned counsel for the parties and

considering the facts and circumstances of the case, this Court is

inclined to enlarge the petitioner on bail. The above named

petitioner is directed to be released on bail on furnishing bail

bond of Rs.10,000/- (ten thousand) with two sureties of the like

amount each to the satisfaction of learned Additional Sessions

Judge-I-cum-Special Judge, NDPS Act, Begusarai in connection

with NDPS Case No. 13 of 2017.
