Learned counsel for the petitioner submits that

Execution Case No. 81 of 2018 is pending in the Court of

learned Sub-Judge-III, Patna but there is no progress in the same

so he filed this petition for direction for expeditious disposal of

the Execution case. Earlier due to Covid pandemic the progress

of the case has already been delayed. Learned counsel for the

petitioner submits that this case may be disposed of with liberty

to the petitioner to move appropriate application before the

Court concerned in this regard.

Learned counsel for the respondents appeared and

submitted that First Appeal against the decree has already been

pending and this application of petitioner is misconceived.

In view of the submission of the learned counsel for

the petitioner, this Civil Miscellaneous petition is disposed of

with liberty as prayed for on behalf of petitioner. Both the

parties shall cooperate the Court below in disposal of the

aforesaid Execution Case pending in the Court below, in

accordance with law.
