2. In the instant petition, petitioner has prayed for following reliefs:-

" That this writ application is being file in the nature of writ of certiorari for quashing the order dated 22.6.2016 (so far the petitioner is concerned), issued under the signature of Chief Engineer, Rural Works Department, Bihar, Patna vide letter no. 7567 by which and where under the petitioner is debarred from participation of the future tender after proclamation of defaulter due to n on per formation of the works as per guide line given in the agreement and for issuance of any appropriate writ or writs, order or orders, direction or directions as your lordships may deem fit and proper."

3. Annexure – 9 dated 22.06.2016 reads as under:-

Perusal of the aforementioned document it is evident that petitioner has not been heard, like issuance of notice and obtaining explanation and proceeded to pass speaking order after due consideration of petitioner's explanation etc. That apart, petitioner has been debarred in participating in future tender. This has been deprecated by the Apex Court. Hence, petitioner has made out a case. Accordingly, Annexure-9 dated 22.06.2016 stands set aside. The present writ petition stands allowed reserving liberty to the concerned respondent to complete the process within a period of four months from the date of receipt of this order.

5. The concerned authority is hereby directed to take note of Apex Court's decision UMC Technologies Pvt. Ltd. vs. Food Corporation of India and Another, reported in (2021) 2 SCC 551 read with Isolators and Isolators through its Proprietor Mrs. Sandhya Mishra Vs. Madhya Pradesh Madhya Kshetra Vidyut Vitran Co. Ltd & Another reported in 2023 LiveLaw (SC) 330 (para 34) before taking further action in the matter.
