ORAL JUDGMENT

Date : 29-10-2024 In the instant petition, petitioner has prayed for the following relief(s):-

1. For issuance of appropriate writ(s), order(s),direction(s) to the respondents to demarcating the land of purcha holders which has been issued vide memo no. 622 dated 03.04.1992 by Sub-Divisional Officer, Jhanjharpur being Khata No. 36, Plot No. 572 and Plot No. 81 total area 16 Katha 5 Dhur +7 Katha (Total 1 Bigha 3 Katha 5 Dhur) which has been situated in Bagmariya, under Block- Khutauna, District- Madhubani on the ground of after receiving the purcha petitioner has paid the revenue to the Government and that the rent receipt and after demarking the land fix the area 1 Bigha 3 Katha 5 Dhur and given the possession of the petitioner according to purcha from the above land and petitioner has filed several representation before authorities which is pending.

Learned counsel for the petitioner submitted that petitioner has filed representation before the Circle Officer, Khutauna, Madhubani on 02.04.2018 for demarcation of land bearing Khata No. 36, Plot No. 572 and Plot No. 81 total area 16 Katha 5 Dhur +7 Katha (Total 1 Bigha 3 Katha 5 Dhur) situated in Bagmariya, under Block- Khutauna, District- Madhubani but up till now, no action has been taken by the concerned authority for demarcation of aforesaid land.

3. Learned counsel for the State submitted that petitioner's application is without any receiving and it has not been clarified from the application itself that said application has been filed before the Circle Officer, Khutauna, Madhubani or not.

Considering the facts and circumstances of the case, the present writ petition stands disposed of with liberty to petitioner to raise his grievance regarding demarcation of the land in question before the concerned Circle Officer within a period of five weeks from the date of receipt of this order. If petitioner raises his grievance before the concerned Circle Officer, the concerned Circle Officer is directed to pass appropriate order on the representation of the petitioner within a period of six weeks from the date of its filing in accordance with law after hearing the necessary party.
