Heard learned counsel for the petitioner and learned
APP for the State.
The petitioner has prayed for bail in a case registered
for the offence punishable under sections 399, 402, 412 of the
Indian Penal Code and sections 25(1b)a, 26 and 35 of the Arms
Act.
As per allegation in the FIR, on getting secret
information about gathering of antisocial element, patrolling
party proceeded on place of occurrence. On seeing the police
personnel, accused persons started to escape but on chase five of
them including the petitioner were apprehended. It is further
alleged that one motorcycle, one loaded pistol, one live
cartridge and mobiles were recovered from the accused persons.
It is submitted by learned counsel for the petitioner

that petitioner has been falsely implicated in this case. The
recovered motorcycle is not a looted property rather it belongs
to father of co-accused Ujjual Kumar. Police took the signature
of the petitioner on blank paper to which later on it was
manufactured as seizure list by them. Petitioner is languishing in
judicial custody since 11.07.2021.
The application for bail is opposed by learned APP for
the State.
Having heard learned counsel for the parties and
considering the facts and circumstances of the case, this court is
inclined to enlarge the petitioner on bail. The above named
petitioner is directed to be enlarged on bail on furnishing bail
bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
of the like amount each to the satisfaction of the learned
Additional Sessions Judge-Xth, Jehanabad in connection with
Parasbigha P.S. Case No. 113 of 2021.
