PATNA HIGH COURT
Mr. Justice Madhuresh Prasad
RAVI KUMAR – Appellant
Versus
The State – Respondent
CR. MISC./51771/2022
The court has the discretion to grant bail to an accused person if it is satisfied that there are reasonable grounds to believe that the accused is not guilty of the offence charged or that he is not likely to commit any offence while on bail.
Headnote:
BAIL - SECTION 439 CRPC - LYNCHING - BLINDFOLDING - SNATCHING MONEY - FORCED ELECTRONIC TRANSFER - NO RECOVERY - CHARGE-SHEET SUBMITTED - NO TIP - CUSTODY SINCE 31.01.2022 - BAIL ALLOWED
Fact of the Case:
The petitioner was arrested in connection with a case registered for the offence punishable under Sections 341, 323, 420, 379, 386, 34 of the Indian Penal Code (for brevity ‘IPC’). The allegation was that the informant was on his way home after closing down his cyber cafe, when he has been lynched by some persons after they have blindfolded him. They have taken him in the field, snatched Rupees one lakh and fifty thousand (1,50,000/-) and forced him to make electronic transfer of some more funds.
Finding of the Court:
Considering the rival submissions, the fact of lodging of compliant case no. 822/2021 by the petitioner’s mother and the period of custody, this Court, for the purposes of grant of bail, is inclined to accept the submissions advanced by the petitioner’s counsel. Prayer for bail of the petitioner is allowed.
Issues: Whether the petitioner is entitled to bail?
Ratio Decidendi: The court considered the fact that the petitioner has been in custody since 31.01.2022, the charge-sheet has already been submitted, and there has been no recovery of any incriminating material from the petitioner. The court also noted that the petitioner’s mother had earlier filed a complaint case against the informant.
Final Decision: The court allowed the petitioner’s bail application and directed that he be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each.
