Date : 29-10-2024 Heard learned counsel for the petitioner and learned AC to GP-23.
2. Learned counsel for the petitioner submits that the instant writ application has been filed seeking quashing of the order contained in Memo No. 104 dated 31.01.2023 (Annexure- P/2) issued by the RDDE, Purnea Division, Purnea to the extent whereby the 1st MACP has been granted to the petitioner w.e.f. 25.06.2021 i.e. the date of exemption from passing the departmental examination was granted to the petitioner vide letter no. 1270 dated 17.11.2022 (Annexure-P/1). The petitioner further seeks a direction upon the respondent no. 3 i.e. the RDDE, Purnea Division, Purnea to grant the petitioner 1st and 2nd MACP w.e.f. 27.12.2009 and 27.12.2019 respectively in the light of various judgments including Full Bench Judgment of this Hon’ble Court whereby it has been decided that the passing of the departmental examination is not a condition precedent for grant of ACP and MACP, further to treat the petitioner in a manner similar to Mala Devi who also like the petitioner was granted MACP from the date of exemption from passing of the departmental examination but the same was quashed vide order da
