Date : 19-01-2024 Heard Mr. Deepak Kumar, learned counsel appearing on behalf of the petitioner; Mr. Sushil Kumar, learned GP-22 along with Mr. Uday Prasad, learned AC to GP-22 for the State and Mr. Rakesh Kumar Jha, learned counsel for the respondent no.8.
2. The petitioner has filed the writ petition for the following reliefs:
“That this application is for quashing the order passed by the respondent no.3, Joint Registrar, Co-operative Societies, Darbhanga Division, Darbhanga in transferred membership Appeal Case No.2/2022 on 14.12.2022/11.01.2023 issued vide memo No.7 dated 11.01.2023 contained in Annexure-1, where respondent No.2 has transferred the membership appeal case No.17/22 which was filed by the Six appellants (respondent nos. 8 to 13 of the writ petition) under Rule-7 of the Bihar Co- operative Societies Rules, 1959 such transferred Appeal is against the provision of law and out of only six appellants (Respondent No.8 to 13 of this writ application), respondent no.3 has stated in his order vide Annexure-1 that 269 persons are liable to make members under the provision of Rule – 7(e) of the Bihar Co-operative Societies Rules, 1959 after ignoring the aspect of
