ORAL JUDGMENT

Date : 22-03-2024 Heard learned counsel for the petitioners and learned counsel for the State.

2. The present writ petition has been filed for directing respondent No.4, the District Magistrate, Aurangabad to initiate the process of selection for appointment of Class IV employees in terms of Bihar Group D (Recruitment and Service Conditions)Rules, 2009 which has been enforced with effect from 26.03.2010, as these petitioners are working as daily wages employees in the office of respondent No.4.

Learned counsel for the petitioners submits that the petitioners have been working as daily wages employees in the office of respondent No. 4, namely, the District Magistrate-cum- Collector, Aurangabad since 2012. Learned counsel for the petitioner placed his reliance on an order dated 26.07.2019 passed in CWJC No. 10967 of 2018 by which respondent No.4 was directed to complete the entire exercise of the selection process within 10 months but till date no such selection process for appointment of Group -D by respondent No. 4 has been made.

On the other hand, learned counsel for the State submits that with regard to the appointment of Class -IV post, this Hon’ble Court has pleased to pass an order in the case of Kapil Kumar Vs. the State of Bihar and Others with analogous cases (CWJC No. 18612 of 2019, CWJC No. 19179 of 2019 and CWJC No. 19753 of 2019) which has been duly approved by the Hon’ble Division bench of this Court vide order dated 17.02.2024 passed in LPA No. 1183 of 2023 with analogous cases. Counsel further submits that the state government has framed a new Rule namely “fcgkj dk;kZy; ifjpkjh@ifjpkjh ¼fof'k"V½ ¼HkrhZ ,oa lsok 'kÙksZ½ fu;ekoyh] 2023” for appointment of Class IV employees in the different offices of the Bihar Government and, therefore, the petitioners have now only option to appear in the appointment process which shall begin in the light of 2023 Rules.

5. In this view of the matter, this Court is not inclined to grant any relief to the petitioners. Hence, the present writ petition stands dismissed.
