2. The present interlocutory application has been filed on behalf of the appellant for suspension of sentence and grant of bail during pendency of the present appeal.
3. The appellant has been convicted and sentenced to undergo rigorous imprisonment for life and fine of Rs. 20,000/- and, in default of payment of fine, to further undergo simple imprisonment for one year for the offence under Section 302 of the Indian Penal Code .
4. It has been submitted on behalf of the appellant that the appellant has wrongly been convicted by the learned Trial Court. The learned Trial Court has not appreciated the evidence available on record. Further, it has been submitted that the appellant has been in custody since 12.02.2020 and has remained in custody for approximately six years, and there is no chance of the appeal being taken up for hearing in near future.
