Judicial compliance requires law enforcement agencies to adhere to court directives in missing persons cases.

4 10-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. On the last date i.e., on 15.11.2025, a co-ordinate Bench of this Court had passed the following order:

“1. Heard Learned counsel for the petitioner and learned APP for the State.

2. Taking into consideration the fact that victim is still traceless, let the Superintendent of Police, Sitamarhi inquire into the whereabouts of the missing victim girl and also try to trace her out in view of the mobile no. 8235362021 which has transpired during course of investigation belonging to an unknown boy, with whom she is said to be eloped.

3. List this case on 08.12.2025.

4. On the next date of hearing, Superintendent of Police, Sitamarhi will file a report with regard to whereabouts of the victim girl.

5. Let a copy of this order be communicated to the Superintendent of Police, Sitamarhi, for its due compliance.”

In spite of the aforesaid order, the Superintendent of Police, Sitamarhi, did not bother to submit a report to this Court personally about the whereabouts of the victim instead he has simply forwarded the report of the Investigation Officer, that too, addressed to him regarding the progress of the case while forwarding Xerox copy of the case diary. It is really unfortunate on the part of the Superintendent of Police, Sitamarhi, and it amounts to completely disobedience of the Court’s order.

4. Under such circumstances, let notice be issued to the Superintendent of Police, Sitamarhi to file show cause as to why the direction contained in order dated 15.11.2025 has not been complied by him as also why appropriate steps be not taken against him for his negligence and casual approach in the matter.

5. The explanation must be submitted by 18^th December, 2025.
