14 16-12-2025 Perused the letter No.147 dated 13.12.2025 written by Ara. It appears from the letter that the records were received in Bhojpur, Ara on transfer from the court of learned District and Additional Sessions Judge-I, Bhojpur, Ara but without T.C. The C.I.S. shows that the records were pending from 25.05.2022 to 20.03.2023 with the court of learned District and Additional Sessions Judge-I, Bhojpur, Ara and as per the information available in this letter, it appears that the statements of three accused persons were recorded in the said court.

2. Mr. Ansul, learned senior counsel representing the appellants has placed before this Court a xerox copy of the statements under Section 313 Cr.P.C. This is not the certified copy of the statements, therefore, it is not possible for this Court to rely upon the xerox copy of the statement without its verification and/or availability of the original copy on the records.

3. In the circumstances, we direct the learned Principal District Judge, Bhojpur, Ara and the learned trial court both to once again make efforts to find out the records, if any, Judge-I, Bhojpur, Ara. The statements under Section 313 Cr.P.C.

in original be sent to this Court.

4. Let the xerox copy be made available to the learned Principal District Judge, Bhojpur, Ara and if it is agreed between the parties and the learned trial court finds it just and proper, the step towards re-construction of the records may also be taken.

5. Let this matter be placed under the same heading maintaining its position on 12.01.2026 with the reports and the developments which may take place.
