5 12-12-2025 Heard the parties.
2. The present petition has been preferred:
“against the order dated 12.12.2022 passed in Miscellaneous Appeal No-116 of 2018 by the Hon'ble Court whereby and where under the order dated 21.11.2016 as also order dated 21.12.2017 are modified to the extent that the appellant shall be entitled to Rs. 8 Lakh if the amount awarded with interest is less than it. It was also directed that the amount that has already been disbursed shall be deducted from Rs.8 Lakh. If however it is found that Rs.4 Lakhs, the amount already paid, shall not be recovered from the appellant.”
3. The husband of the the opposite party Late Satyendra Kumar Sharma was traveling with a valid train ticket, entered into Danapur Railway Station for going to Katihar. As there was announcement that the Capital Express will come on Platform No.3, the husband/deceased also came and boarded the train. Later, they realised that the wrong train has been boarded and it is moving in an opposite direction, actually it was an EMU Passenger Train and not Capital Express, chain pulling took place, the train was stopped and those boarded the wrong trai
