A review petition was filed arguing the necessity of original documents during the selection process and questioning its requirements.

2 19-12-2025 Heard Mr. Chakrapani, learned counsel for the petitioner and Mr. Waliur Rehman for the respondent no. 6.

2. The present application has been preferred for review of the final judgment and order dated 21.09.2023 passed in CWJC No. 1734 of 2020 by this Court.

3. This Court on 21.09.2023 in CWJC No. 1734 of 2020 (Pinkee Kumari vs. State of Bihar) took note of the fact that on the day (20.04.2018), when the counseling took place as also the day (28.04.2018), when the selection letter was issued, the petitioner was not armed with the original educational certificate to procure the said selection letter. It is again an admitted fact that she got the mark-sheet on 07.05.2018 as would reflect from the document itself (Annexure-1 series of the writ application). It is again to be noted that she failed in the main examination and ultimately passed through supplementary examination. It is clear from the records that on the day, the counseling/selection took place, she was not having the original certificates.

4. In that background, this Court dismissed the writ petition.

5. Now, the review petition has been filed and it has been recorded that on the day (20.04.2018 and 28.04.2018), when the selection process took place, she was eligible for appointment and as such, there is error in the final order passed in the writ petition.

6. On query as to whether the petitioner was not duty-

bound to produce the original certificates on the day of her counselling, learned counsel for the petitioner submits that he will be bringing on record the rules/regulations to show that even on the basis of photocopies, selection can take place.

7. List this case on 30.01.2026 enabling him to file supplementary affidavit bringing on record the documents in support of his contention that the original certificates are not required on the day counseling takes place/Selection letter is issued.

8. In the meantime, the State as also the respondent no.

6 shall be filing their respective affidavits on the aforesaid points raised by the learned counsel for the petitioner.

9. The State will be bringing on record the entire file relating to the said selection process.
