2 03-12-2025 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 303 (2) of Bharatiya Nyaya Sanhita .

3. As per the prosecution case, the informant had parked his Scooty bearing Registration No. BR- 01BW-9304 in front of his house, but later, despite intense search, he could not find it there.

4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. Neither the petitioner is named in F.I.R. nor he has been put on T.I.P. Nothing incriminating has been recovered from his possession. The name of petitioner sprang up in this case on the basis of his confessional statement. It is further submitted that the alleged Scooty was recovered from possession of co-accused Bhola Kumar.
