ORAL JUDGMENT

Date : 08-01-2026 Heard the parties.

2. The grievance of the petitioner is in a limited bound to the extent that in the Centre in question, where he had appeared as a student of NEET UG Examination, 2025 held on 04.05.2025, on account of mismanagement and delay in distribution of question papers and answer sheets to the appearing candidates, the petitioner along with others had not been allowed to utilize the complete three hours and almost 30- 35 minutes of examination stood wasted and thus cause serious prejudice and sufferings. In the aforesaid facts, he prayed for re test of the NEET UG Examination 2025 of the said Centre.

3. In pursuant to the order of this Court dated

09.09.2025, a counter affidavit has been filed on behalf of the NTA duly sworn by its Director. Refuting the allegation levelled in the writ petition, it is categorically submitted that the Principal of the Utkramit Uchch Madhyamik Vidyalaya, Kurthaul, Centre No. 1502107, Centre Name Bapu Pariksha Parisar, Kumhrar, Patna, who was the Centre Superintendent along with the Invigilator of the afore noted Centre, have categorically stated in their respective response that no candidate, including the petitioner, raised any complaint regarding the conduct of the examination or shortfall of time. The examination was duly commenced at 2:00 pm sharp and continued without interruption till 5:00 pm and all the candidates have been extended complete three hours time. It has further been disclosed that after completion of the examination, all the OMR answer sheets were duly collected from the candidates and placed in the pink envelope, sealed in the presence of two candidates from the room, who also acted as witnesses and put their signature. The counter affidavit categorically states regarding strict compliance with the NTA’s prescribed procedure and no mismanagement has been found in the Centre in question.

4. Though the counter affidavit, referred hereinabove, has been filed on 23.09.2025 after serving copy of the same to the learned Advocate for the petitioner but there is no denial of the averments made therein.

In view of the submissions advanced by the learned Advocate for the respondents NTA as well as NMC, besides the specific contention denying any mismanagement and defiance of any terms and conditions in holding the examination, this Court does not find any reason or occasion to continue with the present writ petition.

6. Accordingly, the writ petition stands closed, sans any merit.
