Date : 10-02-2026 Heard learned Advocate for the respective parties.
2. The petitioners are aggrieved with the action of the respondents in not extending the benefit of 3rd M.A.C.P. with effect from the date when the petitioners became entitled like other Government employees.
3. Referring to the averments made in the writ petition and the Annexures appended thereto, Mr. Dilip Kumar Tiwari, learned Advocate for the petitioners, straightway drew the attention of this Court to the order passed by this Court in C.W.J.C. No. 20552 of 2011 and submitted that vide Resolution dated 08.02.1999, the Matric revised pay scale was fixed as Rs.4500-7000 and Graduate trained has been fixed in the revised pay scale of Rs.5500-9000/-. The Matric pay scale and Intermediate trained pay scale merged with after Resolution dated 08.02.1999 in the pay scale of Rs.4500-7000/-. Under the ACP Rules when the avenues of promotion were not available, the petitioners and other identically situated Government Employees have been found to be entitled to the benefit of A.C.P. Accordingly, the petitioners have been allowed 1st ACP from Matric trained in Rs.5500-9000/- and further Rs.6500-
10500/- in the Graduate trained scale as 2nd ACP.
