4 29-01-2026 1. This writ petition, in the nature of Public Interest

Litigation, has been filed by the Petitioners with following

prayer: -

“That the present Public Interest Litigation is being

filed for direction to the Respondents not to re-allot the land

already allotted to Upgraded Higher Secondary School, Barah,

Block-Bikram, Patna to any other department as at present

school runs in 11 Puccka rooms and 3 kachha rooms and no

objection for further construction was granted to the available

1.30 acres adjacent Gairmajurua land and also committee

headed by the District Magistrate, Patna entered to name of

above-mentioned school in first priority, list at Serial No. 132,

LAEO-2 initiated in process, but no any steps taken in spite of

the petitioners raised voice in this respect and for further

direction to the Respondents to initiate steps in to construction

of building of the school for village of children of Barah village

and/or for any other order/orders as Your Lordship may deem fit

and proper under the circumstances of the case.”

2. An interim prayer has been made in the Writ

Petition to stay the construction of Panchayat Bhawan.

3. The learned Advocate General raised a preliminary

objection to this application on the ground that there is no

pleading in the writ petition that there is any construction of

Panchayat Bhawan and, if so, in which specific land.

4. The learned Counsel for the Petitioners also

submits that except in the prayer portion, there is no averment in

the pleadings of the writ petition and, therefore, he seeks liberty

of this Court to withdraw the writ petition to file a fresh writ

petition.

5. Accordingly, the writ petition is disposed of, giving

liberty to the petitioner to file a fresh writ petition.
