ORAL ORDER
2 05-02-2026 Learned counsel for the petitioner by referring to
order dated 14.11.2024 passed in the case of this petitioner in
C.W.J.C. No.7781 of 2025 (Annexure-P/5), submits that the Co-
ordinate Bench, by recording the contention of this petitioner
that the first wife died on 16.11.2021 and the petitioner being
the only surviving wife is entitlement to get the family pension
in terms of Letter No.1549 dated 27.06.2011.
2. From the order dated 14.11.2024, it is evident that
the Assistant Settlement Officer, has requested the Accountant
General of Bihar to issue Pension Payment Order in favour of
the petitioner and intimate the same to the Department, but till
date, no authority letter has been issued in favour of the
petitioner, and the learned counsel for the State having

concurred with such stand taken by the petitioner in the said
case being C.W.J.C. No.7781 of 2025 wherein, the Assistant
Settlement Officer, Munger, has communicated to the Office of
Accountant General, Bihar to issue P.P.O. but for the reasons
best known to him, the same has not been issued.
3. Learned counsel for the Office of Accountant
General is directed to take instructions from the authority
competent in law, as to why despite such observations having
been made by the Co-ordinate Bench in the case of this
petitioner, which is appended with the writ petition as
Annexure-P/5, such P.P.O. has not been issued.
4. It is made clear that if necessary orders have not
been issued, the same shall be issued within a period of four
weeks from today, by referring to the letter issued by Assistant
Settlement Officer, Munger, as contained in Letter No.1549
dated 27.06.2011 and such order shall be transmitted to the
concerned Treasury Officer for ensuring payment of family
pension to this petitioner, who is said to be the widow of the
deceased employee and necessary orders after verification so
passed, shall be brought on record by way of an affidavit for
further consideration of this Court, failing which this Court will
be constrained to initiate appropriate proceedings against the

person, who is found responsible for not carrying the direction
issued by this Court.
5. List this case on 19.03.2026.
