15 05-01-2026 We find from the cause title of the memo of appeal that the respondent No. 2 is the informant and mother of the victim girl, however, as per the prevailing law, her name, parentage and particulars are required to be masked which shall not be displayed in the records placed in the public domain. 2. In such view of the matter, the Registry is directed no.2 and instead, depict her name as Ms. ‘X’ as also mention the sheet of paper, seal it in an envelope and place the same on the records of this appeal.

3. During the course of hearing of the present case, it has transpired that the deposition of PW-7 Soni Kumari (Investigating Officer of the connected case) is not on record i.e. neither in the paper-book nor in the records of the learned trial court.

We have further noticed that the learned court of Exclusive Special Court (POCSO Act)-cum- 7th Additional Sessions Judge, Bhagalpur has, vide letter dated 01.04.2023 sent the legible photostat copy of the trial court records of POCSO Case No. 02 of 2022 (arising out of Kotwali Tilkamanjhi P.S. Case No. 894 of 2021). Hence, we find that it would be prudent to call for the original records of the learned trial court pertaining to POCSO Case No. 02 of 2022 from the learned court of Exclusive Special Court (POCSO Act)-cum- 7th Additional Sessions Judge, Bhagalpur.

5. The Registry is directed to intimate the learned trial court regarding the present order of this Court and inform the concerned court to send the original copy of the records of the learned trial court by special messenger within a period of five days from today.

6. List this case on 13.01.2026 at 2:15 as the 1st case for final hearing, subject to overnight part heard matters.
