Heard learned counsel for the petitioners, learned senior counsel for the respondent no. 6 and learned senior counsel for respondent nos. 11 to 79.

By order dated 24.11.2011 passed in Objection Case No. 124 of 2011 by the District Teachers Employment Appellate Authority, Darbhanga, the respondent nos. 11 to 79 were directed to be appointed within thirty days. As against this order dated 24.11.2011, learned counsel for the petitioners submits that they had filed an Objection Case No. 43 of 2012 in which an order dated 12.12.2012 was passed rejecting the objection filed by the petitioners.

It is further brought to the notice of this Court that after the order dated 24.11.2011 was passed in Objection Case No. 124 of 2011 by the District Teachers Appellate Authority, Darbhanga in favour of the respondent nos. 11 to 79, the respondent no. 11 filed a writ application bearing CWJC No. 2232 of 2011 which was disposed of by order dated 03.02.2012 (Annexure-11). The order dated 03.02.2012 passed in CWJC No. 2232 of 2012 is reproduced hereinbelow for needful:

“From Annexure-2 it appears that the Appellate Authority has already issued direction to the Employment Agency to issue appointment letters within 30 days to the candidates selected in the process of appointment as Prakhand Teachers. Next document is a letter of the District Education Officer, Darbhanga dated 30.12.2011 addressed to the Block Education Officer, Alinagar giving names of the teachers who are to be appointed pursuant to the direction of the Appellate Authority.

Therefore, it appears that there is no impediment in issue of appointment letters to the candidates selected pursuant to the order of the Appellate Authority as notified by the District Education Officer.

This writ application is, therefore, disposed of with a direction to the Block Education Officer, Alinagar, Darbhanga to comply with the orders of the Appellate Authority in respect of selected candidates named in the said letter of the District Education Officer, Darbhanga, as expeditiously as possible.”

4. From the aforesaid order passed by the Hon’ble High Court in CWJC No. 2232 of 2012, it is clear that the order passed by the Appellate Authority in Objection Case No. 124 of 2011 was upheld and direction was issued to implement the said order.

Learned counsel for the petitioners submits that after these developments have taken place, a meeting of the Block Education Employment Committee was called by Block Development Officer vide office notice dated 05.10.2013 and in the said meeting, the appointment of the private respondent nos. 11-79 were cancelled. He further submits that in pursuance of the decision of the Block Education Employment Committee, the Block Development Officer, Alinagar vide letter dated

28.10.2013 informed the District Education Officer and Block Education Officer to inform the Headmaster of the concerned schools and all illegally
